Sunland announces Reinstatement of its Food Facility Registration
Sunland, Inc. announces that the Food Facility Registration for its Portales, New Mexico location has been reinstated as of today December 21, 2012. Reinstatement brings the company another step closer to the return to full operations.
Over the last several weeks the Company has provided additional information to FDA to demonstrate that recommended actions have been taken and required corrective actions are being implemented. Sunland reached an agreement with U.S. Food & Drug Administration ("FDA") on the terms of a consent decree of injunction, which has been approved and entered by the U.S. District Court for the District of New Mexico. The agreement outlines the required next steps to allow the company to resume its peanut shelling operations and peanut butter manufacturing operations.
Sunland's entire team is fully committed to continuing its work with FDA, its advisory team of experts and all agencies, to insure the manufacturing and distribution of safe, quality foods.
Sincerely,

Jimmie Shearer
PRESS RELEASE
November 27, 2012
Portales, New Mexico
Sunland, Inc. shut down operations in its peanut butter plant just prior to initiating its voluntary recall on September 24, 2012 and shut down shelling operations in its separate peanut mill when the recall was expanded in October. During the last two months Sunland has been working with experts as well as with FDA, analyzing data, and developing and implementing proposed corrective actions in order to be in a position to reopen first the shelling plant and then the peanut butter plant. These plans were submitted to FDA in our response to the inspection observations (Form 483).
Sunland had hoped to recommence its shelling operation on November 26, 2012 and informed the FDA of the plan in a letter dated November 20, 2012. Sunland expected that any agency concerns with its plans would be part of the ongoing dialogue with the agency. The agency's order suspending Sunland's registration on November 26, 2012 was unexpected and the company is disappointed by this development. Sunland's goal remains the sameāto take all appropriate measures for the safe processing and handling of raw peanuts in its shelling plant and the safe production of nut butter products in its peanut butter plant. Sunland is continuing to work with FDA in order to accomplish all steps necessary to begin shelling operations in its peanut mill as soon as possible.
November 15, 2012
At no time in its twenty four year history has Sunland, Inc. released for distribution any products that it knew to be potentially contaminated with harmful microorganisms. The Company has followed internal testing protocols that it believed resulted in the isolation and destruction of any product that did not pass the test designed to detect the presence of any contaminants. In every instance where test results indicated the presence of a contaminant, the implicated product was destroyed and not released for distribution. The Company believed at all times that its response was sufficiently robust such that any product which might be contaminated was isolated and destroyed.
Sunland, Inc. continues to cooperate openly with FDA to address matters related to the recent recall of its products and the inspection of its manufacturing facilities. Sunland has submitted a comprehensive point by point response to the Form 483 observations issued at the close of the inspection. The Company's response is currently under review by the agency. We believe that drawing any inferences much less conclusions about the Company's practices based solely on the observations as set forth in the Form 483 without considering the Company's response would be wholly premature and unduly prejudicial to Sunland. The Company believes that its response to the Form 483 will not only help the agency understand the Company's decision-making process but also lead the agency to confirm that such decision-making was, at all times, conducted in good faith. In deference to the agency's review process, the Company will not publicly discuss its responses until the agency has completed its review.

To all our valued Customers and Consumers:
Our primary concern continues to be your health and wellness, which is the reason for the voluntary recall while FDA, CDC and State Health Agencies investigate to determine the cause of reported illnesses.
In addition, we are moving as quickly as possible in a coordinated effort to execute the recall and obtain the necessary and accurate information from our distributors and retailers, which will allow us to confirm notice of the recall, disposition of the product and related costs in order to begin addressing the specific circumstances of each of our distributors, retailers and consumers.
We would like to thank you for your expressions of support and encouragement. The most current information regarding the ongoing investigation by CDC is available at their website. Additional information is available at the FDA website.
Sincerely,
